These Terms & Conditions ("Terms") govern your access to and use of adgamut.com and the Ad Gamut service (the "Service"). By creating an account or using the Service, you agree to these Terms.

The Service is operated by Innovationz LLC, a Limited Liability Company registered in the State of Wyoming, United States, with its registered office at 1309 Coffeen Avenue #1200, Sheridan, WY 82801, United States. "Ad Gamut" is a trading name of Innovationz LLC; "we", "us" and "our" mean that company. Full details are on our legal page.

1. The Service

Ad Gamut lets you generate short user-generated-content (UGC) style video ads from a product or offer URL, using AI creator avatars, automated voiceover and captions. Features, avatars and limits may change over time.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority where you live, to use the Service. You are responsible for the accuracy of your account details and for keeping your login credentials secure. You are responsible for all activity under your account.

3. Credits, plans & billing

Rendering a video consumes credits. Free and paid plans provide different credit allowances and features. Where paid plans are offered, prices and inclusions are shown on our pricing page. Credits are non-transferable and do not expire. Refunds, cancellations and what happens when a render fails are set out in our Refund Policy, which forms part of these Terms.

4. Your content & responsibilities

You are solely responsible for the URLs you submit and the products you promote. By using the Service you represent and warrant that:

• You have the right to use and promote the product or offer at the URL you submit;
• Your use does not infringe the intellectual property, privacy or other rights of any third party;
• Your ads and their distribution comply with all applicable laws and the policies of the platforms where you post them (including advertising and disclosure rules).

5. Acceptable use

You agree not to use the Service to create content that is unlawful, deceptive, defamatory, hateful, sexually explicit involving minors, or that promotes illegal goods or services; to impersonate any person or brand without authorisation; to infringe third-party rights; or to attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.

6. AI-generated content

Videos and avatars are generated by automated systems and depict AI creators, not real people. You are responsible for reviewing generated content before publishing and for disclosing the use of AI creators where required by law or platform policy. We make no guarantee that generated content is accurate, non-infringing, or suitable for any particular purpose.

7. Intellectual property

Subject to your compliance with these Terms and payment of any applicable fees, you own the video outputs you generate for your own products and may use them for commercial purposes. We and our licensors retain all rights in the Service itself, including software, avatars, templates, branding and underlying technology.

8. Third-party sites & content

The Service fetches information from URLs you provide and may link to third-party sites. We are not responsible for the content, policies or practices of any third party.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement and availability. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Ad Gamut will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Ad Gamut from any claims, damages or expenses arising out of your content, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm us, other users or third parties.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, and the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute arising from them. Applicable mandatory consumer protections in your country of residence still apply.
